These terms of service apply to every offer from SWOLY Supplements and to every agreement concluded remotely between SWOLY Supplements and customers via getswoly.top. By purchasing our products, you agree to these terms.

2. Definitions
- Customer: the natural or legal person who purchases our supplement products.
- Purchase Agreement: an agreement concluded between SWOLY Supplements and the customer for the sale of supplement products.
- Cancellation Right: the client's ability to cancel the agreement within the specified notice period.
3. Applicability
These terms apply to every offer from SWOLY Supplements and to every purchase agreement concluded between SWOLY Supplements and customers. Deviations are only valid if confirmed in writing.
4. Products and information
- Our product offerings include a complete and accurate description of the offered supplement products. Obvious mistakes or errors do not bind SWOLY Supplements.
- Product images and descriptions are indicative of our products and may vary in detail.
- These products are not intended to diagnose, treat, cure, or prevent any disease. Consult with a healthcare professional before use.
5. Pricing
- All prices are in US dollars and exclusive of applicable taxes unless otherwise stated.
- SWOLY Supplements may change prices. For existing orders, the price at the time of purchase applies.
6. Order formation
The purchase agreement is formed when the customer places an order and meets the specified conditions (including successful payment), after which SWOLY Supplements electronically confirms receipt of the order.
7. Payment
- Payment is made via the payment methods offered on our website. SWOLY Supplements may cancel orders that are not (fully) paid.
- In case of non-payment, SWOLY Supplements is entitled to charge reasonable costs arising from collection.
8. Product delivery and execution
- SWOLY Supplements will handle and execute orders with the greatest possible care.
- Delivery times mentioned on the website are indicative. Exceeding these times does not give rise to compensation, unless otherwise agreed in writing.
- The risk of damage and/or loss rests with SWOLY Supplements until the product is delivered to the customer, unless explicitly agreed otherwise.
9. Cancellation rights
- The customer may cancel the order within 30 days after receiving the product without giving reasons.
- During the notice period, the customer will handle any received products carefully and only use them to the extent necessary to assess the nature, characteristics and functionality.
- To exercise the cancellation right, the customer can send an unambiguous declaration to contact@getswoly.top.
- The customer returns any received products as soon as possible, but no later than 30 days after cancellation, in original condition and packaging, insofar as reasonably possible.
- In case of a valid and timely cancellation, SWOLY Supplements refunds all payments received from the customer within 14 days after receipt of the returned products or proof of return.
10. Exceptions to cancellation
The cancellation right is excluded for products that have been consumed or partially used, as well as for products that are clearly personalized or made according to the customer's specifications.
11. Conformity and guarantee
- SWOLY Supplements warrants that the products comply with the agreement and the legal provisions and/or government regulations existing at the time of purchase.
- If a product does not conform to the agreement, you must report this within a reasonable period after discovery via contact@getswoly.top. We will then provide you with an appropriate solution.
- Our products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease. Results may vary.
12. Liability
- SWOLY Supplements is not liable for indirect damage, consequential damage or lost profits. Our total liability is limited to the amount of the purchase to which the liability relates, unless mandatory law provides otherwise.
- Use products in accordance with any instructions provided and normal supplement practices.
- Consult with a healthcare professional before using our products, especially if you have any medical conditions or are taking medications.
13. Force majeure
SWOLY Supplements is not obliged to fulfill any obligation if it is prevented from doing so due to force majeure (e.g., technical failures, natural disasters, strikes, pandemics, government measures).
14. Personal data
We process personal data according to our privacy policy. There you can read which data we process, for what purposes and what your rights are.
15. Intellectual property
All (image) materials, texts, logos and layout on the website are protected by intellectual property rights and may not be used or reproduced without prior written permission.
16. Customer content and reviews
Submitted reviews must be honest and genuine. SWOLY Supplements may moderate or remove reviews that are inappropriate or misleading.
17. Discount codes and promotions
Discount codes are personal or campaign-specific, not exchangeable for cash and only valid within the specified period and conditions.
18. Complaint procedure
Do you have a complaint? Report this as soon as possible via contact@getswoly.top with a clear description and order details. We respond within 3-5 business days. If you cannot resolve it with us, you can file a complaint with a supervisory authority.
19. Applicable law and forum
These terms and the agreement are governed by Texas law, with due regard for mandatory consumer protection laws. Disputes may be submitted to the competent court in Texas, without prejudice to legal rights.
